Minutes of Special Commissioners Meeting   -   November 13, 2006

Prior to the opening of the Special Meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

The Special Meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County , New Jersey , was held in the Commissioners’ Meeting Room at 3:00 p.m.  On roll call the following answered to their names:

Gould - Cabrera – Groon – Yes

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by mailing and fax transmitting same to The Herald, Gazette-Leader and The Press on November 8, 2006 at 4:00 p.m.

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

The Clerk announced that the only matter authorized for discussion and any potential formal action was the ongoing JCOW litigation and continued membership of the Borough of Wildwood Crest in that public entity; that the commissioners would be deliberating in closed session immediately upon adoption of the resolution, that the discussion would be released to the public upon conclusion of the matter, and that board will be reconvening in open session after the authorized closed session.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 377-06

(Closed Session – Litigation and/or negotiations with regard to ongoing JCOW litigation and continued membership of the Borough therein)

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

Upon returning from closed session, and there being no further discussion, THE CLERK READ THE FOLLOWING ORDINANCE BY TITLE ONLY:

ORDINANCE NO. 1021

AN ORDINANCE AUTHORIZING THE REPEAL OF ORDINANCE NO. 768 ADOPTED DECEMBER 21, 2992, WHICH ORDINANCE AUTHORIZED INTERLOCAL SERVICE AGREEMENT OF THE BOROUGH OF WILDWOOD CREST, CITY OF WILDWOOD, THE CITY OF NORTH WILDWOOD, THE BOROUGH OF WEST WILDWOOD FOR PARTICIPATION IN THE JOINT CONSTRUCTION OFFICE OF THE WILDWOODS, AND AUGMENTING AND AMENDING CHAPTER 22 – CONSTRUCTION – OF THE CODE OF THE BOROUGH OF WILDWOOD CREST, SECTIONS 22-1 – JOINT CONSTRUCTION OFFICE OF THE WILDWOODS, SECTION 22-2 – OFFICIALS, AMENDING ORDINANCE NO. 875 ADOPTED JULY 26, 2000, AND TO AUTHORIZE THE TRANSFER TO THE DEPARTMENT OF COMMUNITY AFFAIRS, STATE OF NEW JERSEY , ALL RESPONSIBILITY FOR ADMINISTRATION, INSPECTION AND ENFORCEMENT OF THE UNIFORM CONSTRUCTION CODE ON BEHALF OF THE BOROUGH OF WILDWOOD CREST

Mrs. Gould motioned, seconded by Mr. Cabrera, that Ordinance No. 1021 be passed on first reading, advertised according to law, be brought up for second and final reading and public hearing on Wednesday, November 29, 2006 at 7:00 p.m.

There being no further business or discussion authorized for this special meeting, Mrs. Gould motioned, seconded by Mr. Groon, that the meeting be adjourned.
