Minutes of Commissioners Meeting   -   November 21, 2017

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 9:30 a.m.  On roll call the following answered to their names:

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by e-mailing and same to the Gazette-Leader, Herald of Cape May County and The Press on December 1, 2016.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

ORDINANCE NO. 1261

 

ORDINANCE PROVIDING FOR IMPROVEMENT OF VARIOUS ROADS IN AND BY THE BOROUGH OF WILDWOOD CREST, IN THE COUNTY OF CAPE MAY, NEW JERSEY, AND APPROPRIATING $1,145,000 THEREFOR, CONSTITUTING PROCEEDS OF OBLIGATIONS OF THE BOROUGH HERETOFORE ISSUED.

Mrs. Gould motions, Mr. Cabrera seconds that Ordinance No. 1261 be passed on first reading, advertised according to law, be brought up for second and final reading and public hearing on December 6, 2017 at 9:30 a.m.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1061-17

Governor’s Council on Alcoholism and Drug Abuse

Fiscal Grant Cycle July 1, 2018 to June 30, 2019

 

WHEREAS, the Governor’s Council on Alcoholism and Drug Abuse established the Municipal Alliances for the Prevention of Alcoholism and Drug Abuse in 1989 to educate and engage residents, local government and law enforcement officials, schools, nonprofit organizations, the faith community, parents, youth and other allies in efforts to prevent alcoholism and drug abuse in communities throughout New Jersey.

WHEREAS, the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, State of New Jersey recognizes that the abuse of alcohol and drugs is a serious problem in our society amongst persons of all ages; and therefore has an established Municipal Alliance Committee; and,

WHEREAS, the Borough of Wildwood Crest further recognizes that it is incumbent upon not only public officials but upon the entire community to take action to prevent such abuses in our community; and,

WHEREAS, the Board of Commissioners of the Borough of Wildwood Crest has applied for funding to the Governor’s Council on Alcoholism and Drug Abuse through the County of Cape May;

NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, State of New Jersey does hereby authorize the submission of the grant for the Greater Wildwood Municipal Alliance Consortium grant in the amount of:

1.        The Borough Commission does hereby authorize submission of a strategic plan for the

Greater Wildwood Municipal Alliance grant for fiscal year 2019 (July 1, 2018– June 30, 2019) in the amount of:

       The Borough of Wildwood Crest portion of the local cash match shall be $ 1,524.

 

2.       The Board of Commissioners of the Borough of Wildwood Crest acknowledges the terms and conditions for administering the Municipal Alliance grant, including the administrative compliance and audit requirements.

RESOLUTION NO.  1062-17

 

Authorizing Partial Award of a Professional Services Agreement

for Engineering Design Associated with the Reconstruction of Newark Avenue

 

WHEREAS, the Borough of Wildwood Crest requires the professional services of an Engineering firm specializing in Engineering Design Associated with the Reconstruction of Newark Avenue; and

 

WHEREAS, it is desired to employ a professional, pursuant to law, who is duly trained, experienced and specialized in the area of engineering; and

 

WHEREAS, the Local Public Contracts Law provides for the entering into of a contract for professional services pursuant to R.S.40A:11-5(1)(a), without advertising for competitive bidding; and

 

WHEREAS, the Borough has determined that the firm DeBlasio & Associates, of Wildwood, New Jersey is qualified to perform said work and it is desired to enter a professional contract with DeBlasio & Associates for said services pursuant to law, and to provide for the advertising of a notice pursuant to law; and

 

WHEREAS, the firm DeBlasio & Associates, has completed and submitted a Business Entity Disclosure Certification which certifies that DeBlasio & Associates, will not make any reportable contributions pursuant to N.J.S.A. 19:44A-1 commencing November 21, 2017 to any political committee or candidate through the term of this contract;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, as follows:

 

1.                   The firm DeBlasio & Associates, of Wildwood, New Jersey is hereby retained as Engineer to provide specialized professional services for Engineering Design Associated with the Reconstruction of Newark Avenue, for the period not to exceed one year.  Authorization of $70,000 is a partial encumbrance of the $145,000.00 professional service fee contained in the DeBlasio & Associates September 18, 2017 proposal.

 

2.                   The Commissioner of Public Works and Borough Clerk be and they are hereby authorized and directed to enter into a partial contract with the firm DeBlasio & Associates of Wildwood, New Jersey for specialized professional services for Engineering Design Associated with the Reconstruction of Newark Avenue, for the period indicated above, which contract shall provide for payment at the not to exceed amount of Seventy Thousand ($70,000) dollars.  Said award is further contingent upon the certification of availability of funds below by the CFO.

 

3.                   This partial award of contract is awarded without competitive bidding as a professional service in accordance with the provisions of the Local Public Contracts Law aforesaid, and in accordance with the provisions of N.J.S.A. 19:44A-1, and shall be in a form approved by the Borough.

 

4.                   The Business Disclosure Entity Certification and the Determination of Value shall be placed on file with this Resolution.

 

5.                   This Resolution and a copy of the contract for professional services shall be maintained on filed in the offices of the Borough Clerk for public inspection.

6.                   A copy of this Resolution shall be published in the legal newspaper designated by the Borough as required by law, within ten (10) days of its passage.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1063-17

WHEREAS, the Borough of Wildwood Crest adopted Resolution No. 1119-13 on October 2, 2013 authorizing the appointment of Alicia A. Belansen, License # N-1527, as Temporary Chief Financial Officer effective October 7, 2013; and thereafter adopted Resolution No.  140-14 on April 30, 2014 authorizing the appointment of Alicia A. Belansen as Chief Financial Officer for the Borough of Wildwood Crest for a four (4) year term effective November 14, 2013 through December 31, 2017; and

 

WHEREAS, the Borough of Wildwood Crest then adopted Resolution No. 820-16 on December 14, 2016, which reappointed Alicia A. Belansen as Chief Financial Officer of the Borough of Wildwood Crest for a term of four years and memorialized that her first term actually expired on December 31, 2016; and Resolution No. 855-17 on January 4, 2017 which reappointed Alicia A. Belansen as Chief Financial Officer of the Borough of Wildwood Crest effective January 1, 2017 for a term of four (4) years; and

 

WHEREAS, Alicia A. Belansen has served continuously in excess of four (4) years, since November 14, 2013 as the Chief Financial Officer of the Borough of Wildwood Crest; and

 

WHEREAS, pursuant to the provisions of N.J.S.A. 40A:9-140.8, Alicia A. Belansen has served as the Chief Financial Officer of the Borough of Wildwood Crest in excess of four (4) consecutive years, (since November 14, 2013), has been reappointed as the Borough of Wildwood Crest’s Chief Financial Officer for a term of four years by Resolution 855-17, and has filed evidence of her compliance with this statute section with the Clerk of the Borough of Wildwood Crest and the Division of Local Government Service in the Department of Community Affairs; and

 

WHEREAS, the Board of Commissioners of the Borough of Wildwood Crest has determined that it is in the best interests of the Borough of Wildwood Crest to adhere to, comply with, and satisfy the provisions of N.J.S.A. 40A:9-140.8, and certify and grant tenure to Alicia A. Belansen in the position of Chief Financial Officer of the Borough of Wildwood Crest effective November 15, 2017.

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, State of New Jersey, as follows:

 

            1.         The allegations of the preamble hereto are incorporated herein as if fully set forth.

            2.         The Commissioners of the Borough of Wildwood Crest duly authorized and acting in such capacity in the Borough of Wildwood Crest do hereby certify and grant tenure and all interests, rights, claims, benefits, protections etc. which are related to, granted by, provided by, or inure from tenure to Alicia A. Belansen, License # N-1527, in the position of Chief Financial Officer of the Borough of Wildwood Crest;

3.         Alicia A. Belansen, License # N-1527, Chief Financial Officer of the Borough of Wildwood Crest is hereby granted tenure in the position and title of Chief Financial Officer of the Borough of Wildwood Crest effective November 21, 2017.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1064-17

SUBJECT:           A RESOLUTION AUTHORIZING APPROVAL OF CHANGE ORDER NUMBER 1-FINAL.

                                PACIFIC AVENUE ADA COMPLIANT CURB RAMP ACCESS IMPROVEMENTS

 

 

WHEREAS, Lexa Concrete, LLC, of Hammonton, New Jersey was awarded the contract known as PACIFIC AVENUE ADA COMPLIANT CURB RAMP ACCESS IMPROVEMENTS via Resolution No. 397-15 on April 15, 2015 for $487,000.00; and

 

WHEREAS, Marc DeBlasio of DeBlasio & Associates has reviewed the quantity additions and deletions for various items and approves Change Order Number 1- Final for PACIFIC AVENUE ADA COMPLIANT CURB RAMP ACCESS IMPROVEMENTS in the net addition of $20,462.00 and a reduction of $60,191.70, all of which is detailed in the attachment to the Change Order and revising the Contract Price to $447,870.30, a net reduction of $39,729.70; and

 

WHEREAS, LEXA CONCRETE, LLC of Hammonton, New Jersey has satisfactorily completed the contract for the project known as PACIFIC AVENUE ADA COMPLIANT CURB RAMP ACCESS IMPROVEMENTS; and

 

WHEREAS, the Contractor has now submitted the final Payment Certificate Number 5 – FINAL on the project on November 9, 2017; and

 

WHEREAS, the Borough Engineer, Marc DeBlasio of DeBlasio & Associates has recommended acceptance of the project as complete.

 

NOW THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May and State of New Jersey, that said Change Order Number 1 – FINAL be and the same are hereby approved.

 

AND BE IT FURTHER RESOLVED that the contract for said work be, and the same is hereby accepted, and that all payments to Lexa Concrete, LLC be made thereon.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1065-17

ACKNOWLEDGING A CONTRACT WITH SOUTH JERSEY ENERGY COMPANY TO PROVIDE NATURAL GAS SERVICES FOR THE COUNTY OF CAPE MAY AND PARTICIPATING CO-OP MEMBERS THROUGH THE SOUTH JERSEY POWER COOPERATIVE

 

WHEREAS, the County of Cape May (hereinafter “County”) is a member of the South Jersey Power Cooperative (hereinafter “SJPC”); and

 

                WHEREAS, Camden County is Lead Agency and awarded a bid to South Jersey Energy Company for the provision of natural gas on behalf of the SJPC.

 

                NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest as follows:

 

  1. Said Board hereby acknowledges a contract with South Jersey Energy Company of Mt. Laurel, New Jersey to provide natural gas services to Cape May County and participating Co-op members through the South Jersey Power Cooperative.
  2. The term of the contract shall be for two years, commencing December 1, 2017 through November 30, 2019 pursuant to the Executive Summary prepared by Concord Energy Services, a copy which is attached hereto and by this reference made a part hereof as Attachment “A”.
  3. Pursuant to the Rules of the Local Finance Board of the State of New Jersey, no amount of this contract shall be chargeable or certified until such time as goods are ordered or otherwise called for prior to placing the order.  The Certification of available funds shall be made by the Chief Financial Officer and attached to the file copy of the purchase order.  It shall be the responsibility of the official issuing the purchase order to notify and seek the Certification of Availability of Funds from the CFO.
  4. All of the above recitals are incorporated herein by reference as if repeated at length.

 

BE IT FURTHER RESOLVED that no participating contracting unit in the Power

Cooperative shall be responsible for any items order or for performance by any other participating contracting unit.  Each participating contracting unit shall be liable only for its own performance and for items ordered and received by it and none assumes any additional responsibility of liability. 

 

STATEMENT

This Resolution acknowledges a 2 year contract awarded by Camden County as Lead Agency for members of the South Jersey Power Cooperative.

WHEREAS, the Wildwood Crest Police Department is desirous of having Caroline Stango and Blake Gorski attend the Cape May County Police Academy; and

 

WHEREAS, the governing body of the Borough of Wildwood Crest has concluded that this would be in the best interests of the Wildwood Crest Police Department, and wishes to authorize same;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that Caroline Stango and Blake Gorski be and they are hereby authorized to attend the Cape May County Police Academy on behalf of the Wildwood Crest Police Department.

WHEREAS, on November 16, 2017 , ERIN BRIDGET WATERS , 124 Greenwich St , Philadelphia, PA 19147 , applied for a Special Events Permit for the purpose of the WATERS-BLACKBURN WEDDING   to be held on APRIL 28, 2018 ,  from 1:00 PM to 4:00 PM, on the HEATHER RD BEACH PIER ; and

                                                                                                                                                         

WHEREAS,  ERIN BRIDGET WATERS , 124 Greenwich St , Philadelphia, PA 19147 , has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and she is hereby authorized and directed to issue a Special Events Permit to  ERIN BRIDGET WATERS , 124 Greenwich St , Philadelphia, PA 19147 for the purpose of the WATERS-BLACKBURN WEDDING to be held on APRIL 28, 2018 , from 1:00 PM to 4:00 PM, on the HEATHER RD BEACH PIER .

RESOLUTION NO.  1069-17

RESOLUTION PROCLAIMING NOVEMBER AS

ADVERSE CHILDHOOD EXPERIENCES AWARENESS MONTH

IN CAPE MAY COUNTY

 

WHEREAS, the Cape Regional Wellness Alliance believes that children are our county’s most precious resource, and

 

WHEREAS, according to the 2017 NJ Kids Count report, for the 7th year in a row, Cape May County is ranked the highest of all 21 New Jersey counties in unemployment, child out-of-home placements, lowest in overall child wellness, and has the highest rate of reported and substantiated investigations of child abuse and/or neglect; and

 

WHEREAS, Adverse Childhood Experiences (ACEs) is a term to describe all types of abuse (emotional, physical, sexual), neglect (emotional, physical), and other traumatic experiences (mother treated violently, substance abuse, mental illness, separation/divorce, incarcerated household member) that occur to individuals under the age of 18; and

 

WHEREAS, Cape Regional Health System through a grant from the Robert Wood Johnson Foundation/NJ Health Initiatives (NJHI) has formed the Cape Regional Wellness Alliance for the goal of Building a Culture of Health in Cape May County; and

 

WHEREAS, by March 2019 the Cape Regional Wellness Alliance will have developed and implemented strategies to reduce the impact of Adverse Childhood Experiences (ACEs) in the communities of Lower Township, Middle Township, Wildwood and Woodbine; and

 

WHEREAS, 2016 Health rankings indicate Cape May County ranked 15th for overall health outcomes, Type II diabetes and obesity, infant and child mortality, as well as adult premature mortality outcomes above state rate with the second highest suicide rate and fourth highest drug abuse deaths; and

 

WHEREAS, neglected and traumatized children face challenges that no child deserves, and damage caused by ACEs often results in young people who develop long lasting harmful behaviors that affect themselves, their families, and their communities; and

 

WHEREAS, the Cape Regional Wellness Alliance expects that this pilot program of reducing the occurrences of ACEs in these four Cape May County communities will be used as a model for county-wide implementation; and

 

WHEREAS, the Cape Regional Wellness Alliance will work in partnership with the Cape Regional Health Needs Coalition and other invested community members to achieve this goal; and

 

WHEREAS, the Cape Regional Wellness Alliance will establish baseline data on the prevalence of ACEs in these four Cape May County communities; and


WHEREAS, the Cape Regional Wellness Alliance will develop and implement a community education program about ACEs and its impact on the Culture of Health in these four Cape May County communities; and

 

NOW, THEREFORE, BE IT RESOLVED that November be proclaimed Adverse Childhood Prevention Month in Cape May County,

 

AND BE IT FURTHER RESOLVED that the Governing Body of the Borough of Wildwood Crest pledges to promote safe and healthy environments for all children encouraging parents, caregivers, educators, and neighbors to provide children with love, security, emotional support, and a strong connection to their extended families and communities,

 

AND BE IT FURTHER RESOLVED that all citizens, service agencies, organizations, medical facilities, schools, businesses, and government entities increase their participation efforts, to strengthen families and communities for the prevention of Adverse Childhood Experiences,

 

NOW, THEREFORE BE IT RESOLVED that the Cape May County Freeholders, School Boards and Town Councils be committed to raising awareness about ACEs and the need to emphasize the importance of providing protective factors and building resiliency among the population.

The South Jersey Gas Grid 1 project is now complete with the exception of the punch list items which must be corrected.   All punch list items are repairs to concrete curb with street cleaning required on to (2) streets. Engineer Marc DeBlasio is working with South Jersey Gas and their subcontractors to schedule all work.  I will report back to you with specific dates.

 

Kayak Launch/ Sunset Lake Shoreline Stabilization

The Army Corps has issued their permit for this project.   NJDEP Land Use Regulation’s comments had initially indicated that an Individual CAFRA permit would be necessary in addition to the Waterfront Development and Coastal Wetlands Permit.  This is inconsistent with the way the shoreline stabilization was previously handled.  Typically an Individual CAFRA permit for a project of this size would be around $30,000 as it is based on acreage.  The Waterfront Development Permit is estimated to cost $3,000 and the Coastal Wetlands Act of 1970 is at a cost of $3000 for a total of $6,000.  After several conversations with our coastal engineer DEP Land Use has now relented and indicated that an individual CAFRA permit is not necessary, which is a significant cost savings to taxpayers. 

We are still working on permitting issues with the kayak launch due to DEP’s opinion that there is shellfish habitat in the immediate area.  I will report back on this shortly.

Rio Grande Avenue Gateway Improvement Project

ENGINEER’S REPORT: The Engineer indicated a formal report will be given at the December 6, 2017 meeting. 

 

 

Public Commentary: The Mayor opened the floor for public commentary. 

 

Chief Joseph McGrath announced the Police will be holding drop off for unwanted/expired prescription drugs on Wednesday (11-22-17) from 10:00 am to 2:00 pm at the Wildwood Crest Volunteer Fire Company and reverse call will be made to residents.

 

Dennis Travascio, 112 E. Louisville Avenue, asked about the Newark Avenue Reconstruction resolution and what was the scope.  The Engineer indicated it was a full reconstruction from the Beach to Pacific Avenue to include sanitary sewer, new drainage, and concrete gutters to name a few.   

 

Hearing nothing further from the public, the Mayor opened new business.

 

New Business:  There was no new business to discuss.

 

Old Business:  The Mayor indicated that all old business was being covered by the Administrator and to wipe the slate clean.       

 

After opening the floor once more, and hearing nothing further from the public, Mrs. Gould motioned and Mr. Cabrera seconded that the meeting be adjourned.  All were in favor.  The time was 9:41 a.m.
