Minutes of Commissioners Meeting   -   December 6, 2017

Wildwood Crest, NJ

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 9:30 a.m.  On roll call the following answered to their names:

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by e-mailing and same to the Gazette-Leader, Herald of Cape May County and The Press on December 1, 2016.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

Mr. Cabrera motioned, seconded by Mr. Groon, that Ordinance 1261 be placed on second and final passage by title only.

THE CLERK READS THE FOLLOWING ORDINANCE BY TITLE:

ORDINANCE NO. 1261

ORDINANCE PROVIDING FOR IMPROVEMENT OF VARIOUS ROADS IN AND BY THE BOROUGH OF WILDWOOD CREST, IN THE COUNTY OF CAPE MAY, NEW JERSEY, AND APPROPRIATING $1,145,000 THEREFOR, CONSTITUTING PROCEEDS OF OBLIGATIONS OF THE BOROUGH HERETOFORE ISSUED.

AN ORDINANCE TO AMEND SECTION 59‑3 OF THE CODE OF THE BOROUGH

OF WILDWOOD CREST, KNOWN AS THE “SALARY ORDINANCE," FIXING AND

DETERMINING SALARIES AND COMPENSATIONS OF THE BOROUGH OF WILDWOOD

CREST, IN THE COUNTY OF CAPE MAY, NEW JERSEY, PROVIDING FOR THE

RAISING OF THE AMOUNTS THEREOF BY TAXATION AND FOR THE TIME AND

METHOD OF PAYMENT

 

Mr. Cabrera motions, Mr. Groon seconds that Ordinance No. 1262 be passed on first reading, advertised according to law, be brought up for second and final reading and public hearing on December 27, 2017 at 9:30 a.m.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1070-17

BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, New Jersey, that the Borough Clerk be and she is hereby authorized, instructed and empowered to advertise Notice of Availability of Requests for Qualifications and Proposals in The Herald of Cape May County issue of December 13, 2017.

 

Sealed Requests for Qualifications and Proposals will be received by the Municipal Clerk, Wildwood Crest Borough Hall, on Friday, December 29, 2017 by 11:00 a.m., prevailing time, for furnishing the items hereinafter set forth in accordance with the Specifications on file in the Borough Hall.  Said items are as follows:

WHEREAS, N.J.S.A. 40A:4-58 permits transfers between budget appropriations during the final two (2) months of the fiscal year;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that transfers between 2017 budget appropriations be and the same are hereby authorized as follows:

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1072-17

BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest that as a result of the sealed bidding which took place on November 28, 2017, at 11:00 a.m., in the Municipal Court Room of Wildwood Crest Borough Hall, during which time O2, INC. t/a OCEAN OUTFITTERS, 6101 New Jersey Avenue, Wildwood Crest, New Jersey submitted the only bid in the amount of Five Thousand Five Hundred ($5,500.00) Dollars for 2018 season, Five Thousand Five Hundred ($5,500.00) Dollars for 2019 season, and Six Thousand ($6,000.00) Dollars for 2017 season, for a term commencing January 1, 2018 and terminating December 31, 2020, for the operation of a beach concession for ocean surf camp/water safety instructions, the precise location to be designated daily as authorized by the Supervisor of the Wildwood Crest Beach Patrol, or his designee.

 

BE IT FURTHER RESOLVED that Joyce P. Gould, Commissioner of Revenue and Finance of the Borough of Wildwood Crest, and Patricia A. Feketics, Borough Clerk, be and they are hereby authorized, instructed and empowered to execute and attest the Lease by and between the Borough of Wildwood Crest and O2, INC. t/a OCEAN OUTFITTERS, incorporating all of the terms and conditions of the above successful ocean surf camp/water safety instruction concession rental bid.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1073-17

BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest that as a result of the receipt of sealed bids which took place on November 28, 2017, at 11:15 a.m., in the Municipal Court Room of Wildwood Crest Borough Hall, during which time WC ICE CREAM, LLC, submitted the only bid amount of $345,500.00 over a three (3) year lease period, the specific breakdown of said bid being as follows: $110,000.00 in calendar year 2018, $115,000.00 in calendar year 2019, and $120,000.00 in calendar year 2020, for the lease of all six (6) specified locations as precisely defined and contained in the bid documents which are made a part hereof by reference as if fully set forth, otherwise known as Concession A, Concession B, Concession C, Concession D, Concession E, and Concession F, situate on the beach in the Borough of Wildwood Crest, and permitted to be utilized for the sale of ice cream and ice cream products, it is hereby determined to be in the best interest of the Borough of Wildwood Crest to accept the only bid, which has been submitted by WC ICE CREAM, LLC, for the said six (6) concession rentals and bid amount set forth hereinabove for calendar years 2018, 2019, and 2020.

 

BE IT FURTHER RESOLVED that the award of this bid is further conditioned upon complete compliance by the Concessionaire of the full provisions set forth in the legal opinion of the Solicitor with respect to the operation of this concession on the beaches of the Borough of Wildwood Crest, as well as all bid documents appertaining thereto.

 

BE IT FURTHER RESOLVED that Joyce P. Gould, Commissioner of Revenue and Finance of the Borough of Wildwood Crest, and Patricia A. Feketics, Borough Clerk, be and they are hereby authorized, instructed and empowered to execute and attest the Lease by and between the Borough of Wildwood Crest and WC ICE CREAM, LLC, incorporating all of the terms and conditions of the above successful ice cream and ice cream products concession rental bid.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1074-17

BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest that as a result of a sealed bidding which took place on November 28, 2017, at 11:30 a.m., in the Municipal Court Room of Wildwood Crest Borough Hall, during which time LAWRENCE ZITTO submitted a bid amount of $46,000.00 per season, over a four (4) year lease period, for the lease of  Crest Pier Bicycle Concession No. 3 as precisely defined and contained in the bid documents which are made a part hereof by reference as if fully set forth, situated upon Block 21.04, Lot 8, and permitted to be utilized for the rental of bicycles, it is hereby determined to be in the best interest of the Borough of Wildwood Crest to accept the only sealed bid, which has been submitted by LAWRENCE ZITTO for the said Crest Pier Bicycle Concession No. 3 and bid amount set forth hereinabove for calendar years 2018, 2019, 2020, and 2021.

 

BE IT FURTHER RESOLVED that Joyce P. Gould, Commissioner of Revenue and Finance of the Borough of Wildwood Crest, and Patricia A. Feketics, Borough Clerk, be and they are hereby authorized, instructed and empowered to execute and attest the Lease by and between the Borough of Wildwood Crest and LAWRENCE ZITTO, incorporating all of the terms and conditions of the above successful bicycle rental concession bid.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1075-17

BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest that as a result of sealed bidding which took place on November 28, 2017, at 11:30 a.m., in the Municipal Court Room of Wildwood Crest Borough Hall, during which time DANIEL BRADLEY dba D R BRADLEY’S BIKES RENTAL submitted the only bid amount of $48,000.00 per season, over a four (4) year lease period, for the lease of bicycle Rental Concession No. 8A as precisely defined and contained in the bid documents which are made a part hereof by reference as if fully set forth, situated at Rambler Road, the area of leasehold to be at a specific location to be determined by the Board of Commissioners, and permitted to be utilized for the rental of bicycles, it is hereby determined to be in the best interest of the Borough of Wildwood Crest to accept the only sealed bid, which has been submitted by DANIEL BRADLEY dba D R BRADLEYS BIKES RENTALS for the said Bicycle Rental Concession No. 8A and bid amount set forth hereinabove for calendar years 2018, 2019, 2020, and 2021.

 

BE IT FURTHER RESOLVED that Joyce P. Gould, Commissioner of Revenue and Finance of the Borough of Wildwood Crest, and Patricia A. Feketics, Borough Clerk, be and they are hereby authorized, instructed and empowered to execute and attest the Lease by and between the Borough of Wildwood Crest and DANIEL BRADLEY dba D R BRADLEY’S BIKES RENTAL, incorporating all of the terms and conditions of the above successful bicycle rental concession bid.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1076-17

WHEREAS, on November 8, 2017, Notice to Bidders was published in The Herald of Cape May County for receipt of bids for Rental of Beach Concession Locations for the rental of Beach Umbrellas, Beach Chairs, Approved Flotation Devices and the Sale of Bottled Water Only on Tuesday, November 28, 2017 at 10:30 a.m. in the Municipal Court Room at Borough Hall, 6101 Pacific Avenue, Wildwood Crest, New Jersey; and

 

WHEREAS, no bids were received or presented at that time; and

 

WHEREAS, it is the desire of the Board of Commissioners of the Borough of Wildwood Crest to re-advertise Notice to Bidders for said concession.

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, New Jersey, as follows:

 

1.  The preamble hereto is repeated herein as if fully set forth;

 

2.          The Borough Clerk be and she is hereby authorized, instructed and empowered to publish Advertisement for Bidders in The Cape May County Herald issue of December 13, 2017.

 

3.          Sealed bids will be received by the Purchasing Committee in the Municipal Court Room, Wildwood Crest Borough Hall, 6101 Pacific Avenue, Wildwood Crest, New Friday, December 29, 2017 at 10:30 a.m., prevailing time, for Rental of Beach Concession Locations for the Rental of Beach Umbrellas, Beach Chairs, Approved Flotation Devices and the Sale of bottled Water Only.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1077-17

WHEREAS, on March 21, 2017 the Wildwood Crest Zoning Board considered the application of The Monarch Condominium Association, owner of the property located at Block 6.03, Lot 21; a/k/a 5501 Atlantic Ave., Wildwood Crest, New Jersey, for hardship variance in connection with the subject property; and

 

WHEREAS, subsequent to the approval of the application by the Wildwood Crest Zoning Board, The Monarch Condominium Association requested, by correspondence dated March 21, 2017, reimbursement of any monies remaining from the escrow fee; and

 

WHEREAS, the Wildwood Crest Zoning Board has recommended (Resolution No. ZB-17-23) the return of the $124.00 balance of escrow fee;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that the Chief Financial Officer be and is hereby authorized and directed to issue a refund of application fee and escrow fee in the amount of $124.00 to The Monarch Condominium Association, 317 Twin pond Dr., West Chester, PA 19382-1943.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1078-17

WHEREAS, AE Stone Inc, 1435 Doughty Rd, Egg Harbor Township, NJ 08234-2229, made a payment of $807.50 to the Borough of Wildwood Crest on October 27, 2017 for Police Detail in Wildwood Crest for estimated 9.5 hours on October 30, 2017, New Jersey; and

 

WHEREAS, the detail was completed in 8 hours, with a total cost incurred of $680, resulting in an overpayment of $127.50; and

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that the Chief Financial Officer of the Borough of Wildwood Crest be and she is hereby authorized and directed to cause a refund in the amount of $127.50 to be made payable to AE Stone Inc, 1435 Doughty Rd, Egg Harbor Township, NJ 08234-2229, for the reasons set forth above.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1079-17

WHEREAS, Utility Line Services, LLC, 1302 Conshohocken Road, Conshohocken, PA  19428, made an escrow payment of $16,150.00 to the Borough of Wildwood Crest on May 22, 2017 for Police Detail in Wildwood Crest, New Jersey; and

 

WHEREAS, the escrow used totaled $15,482.50 and the Chief Financial Officer has requested the return of the unused escrow fee of $667.50; and

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that the Chief Financial Officer of the Borough of Wildwood Crest be and she is hereby authorized and directed to cause a refund of escrow fee in the amount of $667.50 to be made payable to Utility Line Services, LLC, 1302 Conshohocken Road, Conshohocken, PA  19428, for the reasons set forth above.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1080-17

WHEREAS, on November 22, 2017 , DELMOSPORTS LLC , 100 E. Rio Grande Ave , Wildwood, NJ 08260 , applied for a Special Events Permit for the purpose of a TRIATHLON RUN   to be held on AUGUST 25, 2018 ,  from 6:30 AM to 11:00 AM, on the BEACH from CRESSE AVE to CROCUS RD ; and

                                                                                                                                                         

WHEREAS,  DELMOSPORTS LLC , 100 E. Rio Grande Ave , Wildwood, NJ 08260 , has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and she is hereby authorized and directed to issue a Special Events Permit to  DELMOSPORTS LLC , 100 E. Rio Grande Ave , Wildwood, NJ 08260 for the purpose of a TRIATHLON RUN to be held on AUGUST 25, 2018 , from 6:30 AM to 11:00 AM, on the BEACH from CRESSE AVE to CROCUS RD .

 

Mr. Cabrera motioned, seconded by Mr. Groon, that the foregoing Resolution be adopted.

Administrator’s Report:

ENGINEER’S REPORT:

 

Grant Applications

 

1.       FY2018 NJDOT Local Aid

Ø  New Jersey Department of Transportation’s (NJDOT) notified all municipalities that applications are being accepted for the FY2018 State Aid programs. The NJDOT is accepting applications for four (4) categories and they are:  Municipal Aid, Transit Village, Bikeways, and Safe Streets to Transit.

Ø  The Borough selected to submit the reconstruction of Newark Avenue-Phase 2.  The application was submitted by the October 6, 2017 deadline.

 

2.        FY2018 NJDCA Small Cities Application

Ø  New Jersey Department of Community Affairs (NJDCA) notified all municipalities that applications are being accepted for the FY2018 State Aid programs.

Ø  The Borough has selected to submit for ADA improvements at various beach street end access points.  The application was submitted for the September 15, 2017 deadline.

 

Capital Projects

1.       Reconstruction of Newark Avenue

Ø  The survey has been completed and base mapping is almost finished.

Ø  Certified mailings to property owners notifying them of the proposed project and roadway paving is currently being processed for mailing with the Clerk’s office.

General

1.       Bulkhead & Storm Sewer Outfall Inspection

Ø  All beach and bayside bulkheads have been inspected.

Ø  The storm sewer outfall inspections have been inspected.

Ø  The report is currently being finalzed and it is anticipated to be completed by December 15th.

 

Public Commentary: The Mayor opened the floor for public commentary. 

 

Nancy Pietropaoli, 6002 Seaview Avenue, wanted to confirm if the last meeting of the year was on December 27, 2017 at 9:30 a.m. and the Clerk confirmed it was.

 

Hearing nothing further from the public, the Mayor opened new business.

 

New Business:  There was no new business to discuss.

 

Old Business:  There was no old business to discuss.

 

After opening the floor once more, and hearing nothing further from the public, Mr. Cabrera motioned and Mr. Groon seconded that the meeting be adjourned.  Both commissioners were in favor.  Mrs. Gould was absent.  The time was 9:39 a.m.
